News: Myanmar Intellectual Property Department released its inaugural trademark journal
On the first of May in the year 2024, the Myanmar Intellectual Property Department released its inaugural trademark journal. This journal contains an exhaustive list of 220 marks and serves as a crucial component in the trademark registration process. Each trademark is described in detail, including the owner’s particulars, the class(es) of goods and services, and the local agent’s contact information. These trademarks are classified under the globally recognized Nice Classification system, ensuring ease of accessibility for the public.
It is important to emphasize that while publication in the journal is a necessary step, it does not guarantee a trademark’s registration. Rather, it makes the trademark available for opposition by third parties, as stipulated in Section 26 of the Trademark Law. Any third party may object to the proposed trademark’s registration within 60 days of the journal’s publication. To do so, they must file an opposition with the application form TM-8, pay the prescribed fee, and state any grounds mentioned in Sections 13 and 14 of the Trademark Law. If no objections are raised, the trademark will receive final approval from the department for valid registration within the Myanmar jurisdiction.
Consequently, the publication of a trademark in the journal provides the public with an equitable opportunity to scrutinize and voice their disagreement with the trademark. This transparent and impartial process ensures the protection of intellectual property rights while promoting fair competition in the marketplace.
